Terms of Sale for fitbar.ee
1. General Terms
These Terms of Sale outline the relationship between customers of the fitbar.ee online store (“Customer”) and fitbar.ee (“Fitbar OÜ”). They establish rights and obligations for all users and visitors of fitbar.ee who wish to make purchases. By using our website or placing an order, you accept these terms and agree to follow them. Fitbar.ee reserves the right to amend these terms and modify prices. Any updates will be posted on the fitbar.ee website.
2. Establishing the Sales Contract
When the customer confirms an order on fitbar.ee and completes payment, a sales contract is established between fitbar.ee and the customer. This contract is effective only when the customer has paid the full order amount to the Fitbar OÜ account, confirming acceptance of these terms of sale.
3. Pricing
All prices on the fitbar.ee website are listed in euros (€) and include VAT at the rate of 22%. Fitbar.ee reserves the right to change prices without prior notice. Orders paid for before a price adjustment will not be affected. the Customer pays the price displayed at the time of purchase.
4. Ordering and Payment Options
Fitbar.ee provides various payment methods to accommodate Customer preferences, including bank and credit cards, as well as options through Swedbank, SEB Pank, LHV, Luminor, COOP Pank, and Pocopay, Citadel. Orders are processed once full payment is received. Any unpaid orders will not be fulfilled until payment is complete.
5. Product Shipping and Delivery
Once the sales contract is in effect, fitbar.ee processes the order and prepares it for shipping. Orders are dispatched through fitbar.ee logistics partners after payment is confirmed. Estimated delivery times are provided on the fitbar.ee website and are calculated from the date payment is confirmed.
Customers are responsible for ensuring the accuracy of delivery information. If changes to the delivery location or time are needed, the customer must notify fitbar.ee before the item is dispatched. fitbar.ee is not liable for delays or delivery issues arising from incorrect information provided at checkout.
In cases where a product arrives damaged due to shipping (not including packaging), fitbar.ee will replace it if possible or offer a refund for the damaged item.
6. Right of Return
Under Estonian Law (Section 56(1) of the Law of Obligations Act), Customers have the right to return products within 14 days of receiving them. Items must be unused, undamaged, and in their original packaging. The Customer covers the cost of return shipping, up to a maximum of €10 as stated in Section 194(4) of the Law of Obligations Act, unless the reason for return is due to incorrect or defective products.
Customers should notify fitbar.ee of their intent to return items by emailing info@fitbar.ee within 14 days of receiving the order, specifying their name, product details, photo and reason for return. Refunds are processed within 10 calendar days of receiving and inspecting the returned item.
7. Complaints and Claims
In accordance with the Law of Obligations Act, the Customer may make claims for any product defects for up to two years from the date of purchase. If a defect is discovered within six months of purchase, it is presumed to have been present at the time of sale. Customers should report any defects by emailing info@fitbar.ee within two months of noticing the issue, including their name, contact details, and a description of the defect.
fitbar.ee liability does not cover:
- Damage due to Customer’s negligence.
- Defects resulting from misuse or non-intended use.
- Normal wear and tear of the product through regular use.
8. Limitations of Liability and Force Majeure
Fitbar.ee and the customer are responsible for any damages arising from non-compliance with these terms, as permitted by Estonian law. Fitbar.ee is not responsible for any delays or damages caused by unforeseeable events outside of its control.
9. Data Protection and Confidentiality
By using fitbar.ee, the customer consents to the collection and processing of personal data necessary for order fulfillment. Fitbar.ee is committed to protecting customer privacy and will not disclose personal data to third parties unless required for order fulfillment.
10. Resolving Disputes
If disagreements arise concerning these terms, fitbar.ee and the customer agree to attempt resolution through negotiation. Should negotiation fail, the customer has the right to contact the Estonian consumer Protection Board or seek resolution through the courts. Fitbar.ee also reserves the right to pursue legal action to safeguard its rights.
