Terms of Sale for Fitbar.ee
1. General Provisions
These Terms of Sale govern the relationship between the customers of the Fitbar.ee online store (“Customer”) and Fitbar.ee (“FitBar OÜ”).
By using our website or placing an order, you accept and agree to comply with these terms.
Fitbar.ee reserves the right to modify these terms and update prices without prior notice. All updates will be published on the Fitbar.ee website.
2. Conclusion of the Sales Agreement
When a Customer confirms an order at Fitbar.ee and completes payment, a binding sales agreement is formed between FitBar OÜ and the Customer.
The agreement becomes effective only once the full payment has been received into FitBar OÜ’s bank account.
3. Pricing
All prices on Fitbar.ee are listed in euros (€).
Fitbar.ee reserves the right to change prices without prior notice.
Orders paid before a price change will not be affected; the Customer will pay the price that was valid at the time of purchase.

🎁 Gift Card Payments
FitBar gift cards are accepted for purchases in our online store.

Payments via bank links and cards are processed securely by Montonio.
After placing an order, you will be redirected to your online banking environment to complete the payment. Log in, review the pre-filled payment form, confirm or cancel the payment, and return to our website.
Orders are processed only after full payment is received. Unpaid orders will not be fulfilled until payment is completed.
6. Shipping and Delivery
Once the sales agreement takes effect, Fitbar.ee processes the order and prepares it for dispatch.
Orders are shipped via our logistics partners after payment confirmation.
Approximate delivery times are provided on the website and calculated from the moment payment is confirmed.
Customers are responsible for providing accurate shipping information.
If a change in delivery address or timing is necessary, please notify Fitbar.ee before dispatch.
Fitbar.ee is not liable for delays or issues resulting from incorrect information provided during the ordering process.
If an item is damaged during shipping (excluding package damage), Fitbar.ee will either replace the item or offer a refund for the damaged product.
7. Right of Return
According to Estonian law (§56(1) of the Law of Obligations Act), customers have the right to return products within 14 days of receipt.
Products must be unused, undamaged, and returned in their original packaging.
The Customer is responsible for return shipping costs (up to €10 as per §194(4) of the Law of Obligations Act), unless the return is due to an incorrect or defective item.
Customers must notify Fitbar.ee of their intention to return an item by sending an email to info@fitbar.ee within 14 days of receipt, including their name, product details, and reason for the return.
Refunds are processed within 10 calendar days after the returned item has been received and inspected.
8. Complaints and Claims
According to the Law of Obligations Act, customers can file a complaint regarding product defects within two years of purchase.
If a defect appears within six months of purchase, it is presumed to have existed at the time of sale.
Customers must notify Fitbar.ee of any defects via email (info@fitbar.ee) within two months of discovering the defect, including their name, contact information, and a description of the issue.
Fitbar.ee is not liable for:
Damage caused by customer negligence
Defects arising from improper use
Normal wear and tear due to regular use
9. Limitation of Liability and Force Majeure
Fitbar.ee and the Customer are responsible for any damage arising from the breach of these terms according to Estonian law.
Fitbar.ee is not liable for delays or damages caused by unforeseen events beyond its control (force majeure).
10. Data Protection and Privacy
By using Fitbar.ee, the Customer consents to the collection and processing of personal data necessary for order fulfillment.
Fitbar.ee is committed to protecting customer confidentiality and will not disclose personal data to third parties except when required to fulfill an order.
11. Dispute Resolution
If disputes arise concerning these terms, Fitbar.ee and the Customer agree to attempt to resolve them through negotiations.
If negotiations fail, the Customer may refer the matter to the Estonian Consumer Protection Board or seek resolution through the courts.
Fitbar.ee also reserves the right to seek judicial remedies to protect its rights.
