Terms of Sale
1. General Provisions
These Terms of Sale define the relationship between customers of the Fitbar.ee online store (“Customer”) and fitbar.ee (“FitBar OÜ”). They establish the rights and obligations for all users and visitors of Fitbar.ee who wish to make purchases. By using our website or placing an order, you accept these terms and agree to comply with them. Fitbar.ee reserves the right to make changes to these terms and adjust prices. Any updates will be published on the Fitbar.ee website.
2. Conclusion of the Sales Agreement
When the customer confirms an order on Fitbar.ee and makes payment, a sales agreement is concluded between Fitbar.ee and the customer. This agreement only comes into effect once the customer has paid the full order amount to the FitBar OÜ account, confirming their acceptance of these Terms of Sale.
3. Pricing
All prices on the Fitbar.ee website are listed in euros (€) and include VAT at the rate of 22%. Fitbar.ee reserves the right to adjust prices without prior notice. Orders paid before a price adjustment will not be affected. The customer pays the price displayed at the time of purchase.
4. Order and Payment Options
Fitbar.ee offers various payment methods to accommodate customer preferences, including bank and credit cards, as well as options through Swedbank, SEB, LHV, Coop, Citadele, Luminor, Revolut, N26, and PayPal. Orders are processed upon receipt of full payment. Any unpaid orders will not be fulfilled until payment is completed.
5. Shipping and Delivery of Products
After the sales agreement takes effect, Fitbar.ee processes the order and prepares it for shipment. Orders are dispatched through Fitbar.ee’s logistics partners after payment confirmation. Estimated delivery times are specified on the Fitbar.ee website and are calculated from the date of payment confirmation.
Customers are responsible for providing accurate delivery information. If the delivery address or timing needs to be changed, the customer must notify Fitbar.ee before the shipment is dispatched. Fitbar.ee is not responsible for delays or delivery issues caused by incorrect information provided during order placement.
If a product is damaged during delivery (excluding packaging), Fitbar.ee will replace it, if possible, or issue a refund for the damaged product.
6. Right of Return
Under Estonian law (Section 56(1) of the Law of Obligations Act), customers have the right to return products within 14 days of receipt. Returned products must be unused, undamaged, and in their original packaging. The customer covers the cost of return shipping, up to a maximum of €10, as specified in Section 194(4) of the Law of Obligations Act, unless the return is due to incorrect or defective products.
Customers must notify Fitbar.ee of their intention to return products by sending an email to info@fitbar.ee within 14 days of receiving the order, providing their name, product details, a photo, and the reason for the return. Returns are processed within 10 calendar days of receiving and inspecting the returned product.
7. Complaints and Claims
In accordance with the Law of Obligations Act, customers may make claims regarding any product defects within two years of the purchase date. If a defect is discovered within six months of purchase, it is presumed to have existed at the time of sale. Customers must report any defects by emailing info@fitbar.ee within two months of discovering the issue, providing their name, contact details, and a description of the defect.
Fitbar.ee’s liability does not cover:
- Damage caused by customer negligence.
- Defects resulting from improper or unintended use.
- Normal wear and tear from regular use.
8. Liability Limitations and Force Majeure
Fitbar.ee is not liable for delays or failures caused by circumstances beyond its control, including but not limited to natural disasters, governmental actions, labor disputes, or other unforeseen events that prevent normal business operations.
Fitbar.ee and the customer are responsible for any damage resulting from non-compliance with these terms, in accordance with Estonian law. Fitbar.ee is not liable for any delays or damage caused by unforeseen events beyond its control.
9. Data Protection and Privacy
By using Fitbar.ee, the customer consents to the collection and processing of personal data necessary to fulfill the order. Fitbar.ee is committed to protecting the privacy of its customers and will not disclose personal data to third parties unless required for order fulfillment.
10. Dispute Resolution
In the event of disagreements regarding these terms, Fitbar.ee and the customer agree to attempt to resolve them through negotiation. If negotiations fail, the customer has the right to contact the Estonian Consumer Protection Board or seek resolution in court. Fitbar.ee also reserves the right to pursue legal action to protect its rights.
